“Yes, we’re annulled.” That was Kris Aquino’s declaration on “The Big Truth”, a new segment on The Buzz, yesterday, February 5. It was just a taped interview with Boy Abunda, but it was filled with a lot of revelations from the Queen of All Media.
Background
Kris Aquino and James Yap were married in July 10, 2005, and Kris filed for nullity of marriage in August 9, 2010. After a little over a year, their marriage is now annulled.
The interview
Kris told Boy in the taped interview:
“As we speak right now, it is with finality already that yes, we are annulled. Five o'clock talaga. Noong dumating ang five o'clock, ang una kong tinawagan, lawyers ko, nagpasalamat ako. Sila ang nag-advice sa akin ng paraan para everybody can come out with this with a chance for happiness.
“The second call I did was to James. Sinabi ko, 'Congratulation to both of us. We now have the chance to really be happy.'
“Sabi niya, 'O, eh, di liligaya ka na. Good luck sa lovelife mo.'
“Sabi ko, 'Mas good luck sa 'yo. Pag-apihin niya si Bimby, lagot siya sa akin!'”
The reason behind
Some people are wondering why it didn’t take long for the marriage to be annulled, and Kris clarified: “Article 35 [of Family Code], Boy, which states na there was a lack of authority for solemnizing officer.
“Ayoko na to go into details about that. But siguro kasi, when we went into this, we always have the intention of getting married in the Catholic church. Siguro kasi, ang technicality rito, our marriage license stated that we were Roman Catholic. But we were married by somebody who belonged to a different church and is a Minister there. And doon nanggaling, Boy, yung decision ng korte. So, kung tutuusin talaga, because wala yung authority from the start, then we were never really married.”
Other issues
Kris also shared with Boy the following.
On separation of property:
“Yes, we did. That’s the truth,” Kris admitted when Boy asked her if she and James discussed and had separation of property.
“You're advised to do that by your lawyer and you're advised to do that by the judge. It happened almost a year ago. Actually, pinirmahan yun around the time of my birthday (February 14) and James's birthday (February 15) last year.
“I just want to say na kung nilaban namin to the end ang kaso, actually, there was no conjugal properties because there was no marriage from the beginning. Pero siguro, Boy, ang puwede kong ipagmalaki sa lahat, hindi ako greedy na tao. And I would like to give credit to James also kahit na marami ang nanunulsol sa kanya, he didn't listen. I think it was fair. Kung anuman ang napaghatian namin, nangyari yun because we both earned during our marriage. And he got what I think was fair what was given to him and I also got what's fair to be given to me. Para wala nang gulo. Wala na kaming puwedeng habulin pa sa isa't isa.”
On fraternal support:
“I've waived all right to ask for fraternal support kasi sinabi ko na kumikita ako, and it would be voluntary on James's part if he would want to share. Pero hindi ko siya inoobliga.”
On the custody of their son, Bimby:
“He's below seven years old and any child that below seven years old, sa custody yun ng mother. But it doesn't mean na hindi siya puwedeng dalawin ni James because I'm very lenient. Kung kailan kaya ng schedule ni James, he comes to the house. Bimby goes to see him. They go to Timezone, they go to kung saan-saan. So, wala sa akin yun.”
On Bimby’s surname:
“James signed the birth certificate so Bimby is a Yap. But there are legal steps that I must take to protect both Josh (Kris’ son with actor Phillip Salvador) and Bimby. Ang next step kasi rito, I need to adopt my children. That is very complicated at mawi-weird-an ang mga tao. Pero under Philippine Law kasi, if a child was born na hindi kasal ang nanay, illegitimate siya. Because of the ground for an annulment, Bimby is illegitimate. So, kailangan for me to legitimize my own children, kahit na biologically niluwal ko sila. Parang lesson in law talaga itong nangyari sa akin. I need to adopt them para no question of inheritance later on. I am requesting that legally, baby James will be using Aquino Yap. Pinakiusap ko kay James yun at sinabi niya, wala namang problema.”
On her official and legal name:
“Kristina Bernadette Cojuangco Aquino.”
